1. DEFINITION AND OBJECT OF THIS CONTRACT

This agreement ("Agreement") is a distance contract under Article. 50 et seq. D. Lgs. September 6, 2005, No 206 ("Consumer Code"). The contract for the sale of goods between the 19settetre, headquartered in Lecce (LE) P.tta dei Longobardi, 5, P.I. P.I. 04294520756 ("19settetre") and consumers ("Customer"). The Contract is entered directly through the acceptance by the violet of a purchase proposal issued by the Customer by the website www.gabriellachieffo.com (the "Site") according to the methods described in article 3.

2. PRICES

The sales prices of the products shown on the website include VAT. For Italy delivery costs are included in the price listed on the site.

3. MEANS OF PAYMENT

The customer can pay by credit card (Diners, visa, Mastercard, American Express) via Paypal or bank deposit. The Customer guarantees the 19settetre company that he has the necessary authorization to use the mode of payment chosen by him, during the confirmation of the purchase order. The debit for purchases on the customer's account is done at the time of the processing of the order. 19settetre uses all means necessary to ensure the safety and confidentiality of data transmitted online. 19settetre reserves the right to suspend the processing and delivery in the case of a payment authorization by bank card being refused by officially accredited organizations or in the case of non-payment.

The bank is a safe and widely used in Italy who does not possess a credit card.
After the purchase process will send the coordinates for the payment directly to the email address when entering data.

4. PRODUCT SELECTION


It 'can choose the product you are navigating within the categories “Fragrances” and “Room Fragrance” and gain access directly to the product or product list.
Once you find the product you wish to purchase will be sufficient to indicate the amount in the text field, then click on the image depicting the shopping cart to add the item to your cart.

In the section "shopping cart" you will find a list of product candidates with the ability to modify the quantity or remove products that you no longer want to buy.
Clicking on the button "Check out”" you will be directed to the data entry necessary to complete the purchase. 5. SHIPPING

5.1 - SHIPPING COST

5.2 - DELIVERY SERVICES

Products are delivered to the address indicated by the Customer on the purchase order. The Customer must check the exhaustiveness and the conformity of the information which he provides to 19settetre. The latter cannot be held responsible for possible errors of data entry and the consequences in terms of delay or delivery error. In this context, all expenses engaged for the reforwarding of an order will be entirely the responsibility of the Customer. 19settetre cannot be held responsible for delivery delays because of errors or disruptions due to transporters (including in particular in the event of a partial or all-out strike in particular of the mail services, transport and communications).

5.3 - DISPACHING TIMES

Orders placed online via the www.gabriellachieffo.com site are dealt with each day from Monday to Friday, except public holiday. 19settetre does its utmost to treat and dispatch any order received before 11am the very same day, nevertheless the preparation and processing time of an order may be lengthened according to articles, and may require 1 or 2 business days. 19settetre informs its Customers that these delivery times do not include Saturdays, Sundays and public holidays. In the case of an order which may comprise one or more Products not immediately available and one or more products immediately available, 19settetre will dispatch the order as of reception of the whole of the products which comprise the order. If the Customer wishes to receive the products immediately available more quickly, he is advised to isolate these articles in a separate order. An email is automatically sent to the Customer at the time of dispatch of the Products subject to the email address indicated in the order form not containing an error.

5.5 - PACKAGING

The products are packaged so as to respect the standards of transport in force, and to ensure an optimal protection of the products during their delivery. It is requested from the Customer to respect these same standards in the case of a product being returned because of after-sales service or for reasons of suitability. Any damage noted to a product arising from the product not being repackaged properly may lead to an only partial refund, or no refund in the event of the impossibility of resale in its state or in the event of a technical problem indicated having been worsened.

5.6 - RESPONSABILITY OF THE CUSTOMER TO CHECK PARCELS UPON RECEPTION

19settetre reminds customers that it is the responsibility of the Customer to inspect his parcels upon reception in the presence of the deliveryman and to notify the transporter as well as 19settetre company of any anomaly (bumps, damage to the parcel, delivery date not conforming to normal times of the parcel delivery…) within two working days. In the case where such elements are not noted on the delivery slip presented to the Customer by the transporter, no complaint related to the state of the parcel can be accepted a posteriori by 19settetre.

5.7 - DELAYS IN DELEIVERY RELATE TO THE TRANSPORTER

In the case of a delay in delivery compared to the times announced by the transporters, the Customer can contact 19settetre Customer Services by telephone or email in order to create a file of contention or start an investigation to carry out a search for the parcel. It can happen that parcels are mislaid by transporters. The times given by transporters require that the Customer declares the loss in the 10 days following the reception of the dispatch notice sent by 19settetre. Under these conditions, 19settetre accepts the responsibility of contacting the transporter concerned. If the parcel is found, it will be sent immediately to the residence of the Customer. In the event that the parcel is not found, the Customer will be able to ask that the same product be sent again (subject to availability), at 19settetre’s expense, or be refunded the amount paid. If one or more ordered products are not available at that moment, 19settetre will refund the amount paid for the products concerned lost by the transporter.

5.8 - DAMAGED PARCELS

The Customer must inspect the state of the parcel in the presence of the transporter and note any reserves necessary on the delivery slip in the event of partial or total deterioration. In the absence of noting such points, the product is considered to be accepted by the Customer and cannot be the subject of any dispute concerning its delivery. The Customer must notify 19settetre by email so that 19settetre can take the necessary measures as quickly as possible.

6. WARRANTY AND ASSISTANCE 


For products purchased by the customer are applicable to the Violet rules on guarantees and assistance regarding the sale of consumer goods. 


7. CUSTOMER OBLIGATIONS 


Customer represents and warrants that: (i) to be a consumer in accordance with art. 3 of the Consumer Code, (ii) of age, (iii) data supplied by the same for implementation of the Agreement are true and correct.

8. RIGHT OF WITHDRAWAL


8.1 - The Customer has the right to terminate the contract without penalty and without giving a reason within 10 days of receipt of goods. 
The Customer may exercise the right of withdrawal, within that period, showing a telephone or through written communication at the headquarters of the 19settetre of Article. 4, to be sent by registered letter with acknowledgment of receipt or by telegram, telex, email or fax. 


8.2 - Customers wishing to exercise the right of withdrawal must return the products to the address on the invoice, follow the instructions therein contained, within 10 days of receipt of goods. Under Article 55, second paragraph, of the Consumer Code, the Customer has no right of withdrawal in the following cases: 
-delivery of products tailor-made or custom, or by their very nature, can not be returned or are liable to deteriorate or expire rapidly (eg cosmetics, flowers, food); 


8.3 - The costs to return products are the responsibility of Customer. 19settetre to return within 10 days of receipt of goods by the Customer: (i) the overall price paid by Customer for any return is complete with all its parts and functions, or (ii) the part of price equal to the product returned by customers who have actually consumed the product appreciably and / or which significantly diminish the value.

10. JURISDICTION 


The Agreement is governed by Italian law. Any dispute regarding the application, execution, and breach of contract will be the responsibility of the Court of Lecce.

11. FORCE MAJEURE 


In any event of force majeure or unforeseeable circumstances, the 19settetre not be held responsible for delay or non delivery and reserves the right to terminate all or part of the contract, suspend or postpone the execution.
